On October 2, Mr. Beckwith passed away at the age of 79 in his Austin home.
His longtime buddy Tom DeFrank, a contributing editor at National Journal and the leader of the Gridiron Club, claimed that lung cancer was to blame.
Despite the fact that Mr. Beckwith’s report on the Roe case was not widely publicized at the time, it gained new prominence early this year when journalists and historians noted that Politico’s Supreme Court scoop was not wholly uncommon.
The Supreme Court’s original Roe v. Wade judgment was leaked to a Time magazine cub reporter nearly five decades before a significant abortion rights ruling was revealed to Politico.
On January 22, 1973, David C. Beckwith, a recent law school graduate who had worked for Time for about a year, released the news of the court’s decision hours before Justice Harry A. Blackmun announced it. This was a serious violation of court protocol.
In order to learn more about the case, Mr. Beckwith spoke with over a dozen persons, including justices and their clerks.
He claimed to have received assistance from an unnamed source who asked him to hold off on publishing the tale until until January 17, 1973, when the decision was anticipated to be made.
Burger postponed that date, which is how Mr. Beckwith’s story came to be. Mr. Beckwith believed that the chief justice intended to delay the announcement until after Nixon’s second inauguration out of concern of upsetting the president.
